1. Acceptance of Terms
These Terms of Service ('Terms') govern your access to and use of websites, applications, virtual worlds, games, and services provided by Brightkiwi ('we', 'us', 'our'), including PlayWaka (collectively, the 'Service').
By creating an account, browsing our virtual towns, taking quizzes, or interacting with PlayWaka, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Service.
2. Eligibility & Child Safety
PlayWaka is designed to be family-friendly and educational. If you are under the legal age of majority in your jurisdiction (under 18 in New Zealand or 13 in the United States under COPPA regulations), you confirm that you have reviewed these Terms with your parent, legal guardian, or school educator, and that they have consented on your behalf.
Note for Parents & Guardians: You are responsible for supervising your child's online activities and account usage. You may request account review or deletion at any time by contacting our support team.
3. Account Registration & Security
When registering for an account, you agree to provide accurate information and to keep your credentials confidential. You are solely responsible for all activities occurring under your account.
- Choose a screen name that does not disclose your full legal name, home address, or telephone number.
- Keep your password secure and do not share it with other users, friends, or outside parties.
- Notify us immediately if you suspect unauthorized access to your account.
4. Virtual Coins, Gems & Inventory
PlayWaka includes virtual goods such as gold coins, gems, avatar clothing, badges, and titles ('Virtual Items').
Virtual Items Policy: Virtual Items are strictly gameplay mechanics awarded for educational achievements, quests, and quizzes. Virtual Items hold no real-world monetary value, cannot be redeemed for fiat currency, and may not be sold, bartered, or traded outside of the PlayWaka system.
We retain the right to manage, regulate, control, modify, or eliminate Virtual Items at our discretion, without liability to you.
5. Community Code of Conduct
PlayWaka is a respectful learning sanctuary. You agree that you will not:
- Post offensive, harassing, defamatory, violent, sexually explicit, or hateful content.
- Engage in cyberbullying, impersonation of staff, or threatening behavior toward other members.
- Attempt to cheat, exploit glitches, use automated bots, or disrupt game servers.
- Attempt to reverse engineer, decompile, or harvest data from our platform.
- Solicit personal contact details (phone numbers, physical addresses, social media links) from minor users.
6. User Content & Intellectual Property
You retain ownership of any original creative content, articles, or feedback you submit ('User Content'). However, by publishing content on the Service, you grant Brightkiwi a worldwide, non-exclusive, royalty-free license to display, adapt, and distribute your content for the purpose of operating and improving the Service.
All trademarks, logos, artwork, software, game mechanics, and characters belonging to Brightkiwi and PlayWaka remain the exclusive intellectual property of Brightkiwi.
7. Schools & Educational Program Use
Schools and authorized educators utilizing PlayWaka in classrooms agree to use student accounts exclusively for curriculum-supported educational purposes. Educators must ensure parental notice has been distributed according to applicable local educational guidelines.
8. Termination & Account Suspension
We reserve the right to suspend or terminate accounts that violate these Terms, engage in disruptive behavior, or pose safety risks to the community. You may terminate your account at any time by contacting support.
9. Disclaimers & Warranties
The Service is provided on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, whether express or implied. Brightkiwi does not warrant that the service will be uninterrupted, error-free, or entirely free from minor bugs during development.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Brightkiwi and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your access to or inability to use the Service.
11. Governing Law (New Zealand)
These Terms are governed by and construed in accordance with the laws of New Zealand (Aotearoa), without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
12. Modifications & Inquiries
